Twitter Experiment Update #2

Although we have had an incredible amount of engagement the last few weeks, we have not been receiving as much feedback from the #whocanisuebrand campaign on Twitter as we would have hoped.

Regardless, we do have a few responses for you to peruse. You will notice that we are not afraid to highlight the negative comments. After all, this campaign is supposed to show the “honest” thoughts of common consumers.

Bankruptcy Legislation Could Help Homeowners Avoid Foreclosure

According to the Washington Post “More than one million distressed homeowners could benefit from filing for bankruptcy under proposed legislation allowing bankruptcy judges to modify mortgages on primary residences, according to the Congressional Budget Office.”

The provision in the bankruptcy law would allow judges to change the mortgage terms on a primary residence which could keep homeowners from foreclosure. Supporters of the legislation say that the law would provide incentive for the lender to work more closely with borrowers to avoid having a bankruptcy court decide the fate of the mortgage during a bankruptcy filing. Of course, lenders aren’t too keen on the bill and suggest that it would increase their costs and losses.

Headlines on USA Today read, “Bankruptcy filings rise to 6,000 a day as job losses take toll.” The report goes on to state, “Consumer and commercial bankruptcy filings are on pace to reach a stunning 1.5 million this year, according to a report from Automated Access to Court Electronic Records,” and “In May, the number of bankruptcy filings reached 6,020 a day, up from 5,854 in April, AACER says.”

Additionally, the story shares that people are seeking consumer credit counseling; however, since they are in the worst shape ever, it is very hard for credit counselors to be able to help. The article also shares the belief that as corporate bankruptcy filing increases, consumers filing bankruptcy will increase right along with the corporate filings.

Surge in Bankruptcies Highlights Need for More Federal Bankruptcy Judges

As bankruptcy cases in the United States continue to rise, a prominent judicial group has said more federal bankruptcy judges are needed to keep up with the influx of filings.

The bankruptcy committee of Judicial Conference of the United States said federal courts need more judges in order to uphold bankruptcy law and facilitate new filings, which continue to grow at a staggering rate.

The committee suggested that Congress approve the following staffing requests:

  • The addition of 13 new permanent federal bankruptcy judges
  • Transform 22 temporary judgeships into permanent positions

Secured Credit Card after Bankruptcy: Risks and Benefits
